Recording customer details - how we use your information:

As a customer/visitor of Earthbound Holistics you will be asked to provide some basic information and contact details. The following information will be collected:

The names of all customers or visitors, or if it is a group of people, the name of one member of the group
A contact phone number for each customer or visitor, or for the lead member of a group of people
Date of visit and arrival time and departure time
Any health conditions (these are taken to make sure we can safely provide your treatment without causing you any issues.)

Earthbound Holistics as the data controllers for the collection of your personal data, will be responsible for compliance with data protection legislation for the period of time it holds the information. A part of safeguarding your personal data, we will safely discard information that is no longer needed e.g., you are no longer a client, or you’ve asked us to delete your data.

Your information will always be stored and used in compliance with the relevant data protection legislation.
By law, you have a number of rights as a data subject, such as the right to be informed, the right to access information held about you and the right to rectification of any inaccurate data that we hold about you.
You have the right to request that we erase personal data about you that we hold (although this is not an absolute right).

Third party applications:

We use Typeform as a way to collect online consultations and feedback forms for mindfulness coaching. By clicking submit on forms, you acknowledge the information you provide will be transferred to Typeform for processing in accordance with their Privacy Policy and Terms of Service.

General Terms and Conditions:

By using Earthbound Holistics services, you agree to be bound by the following terms and conditions.

1. DESCRIPTION OF SERVICES.
Earthbound Holistics will provide (goods &) services as outlined in our invoice to you, the customer, which you have agreed at the time of placing your order with us.

2. LIMITATIONS OF SCOPE.
Earthbound Holistics will not be responsible for work that is beyond the scope of services set forth in the proposal plan in effect at the time Customer initiates the service. Any changes to the scope of services will not be effective unless approved by both parties.

3. MANAGEMENT RESPONSIBILITY.

Earthbound Holistics will provide certain tools, methods and resources to the customer that are intended to help the customer grow and build its business. However, the Customer is fully and exclusively responsible for its own business performance and Customer satisfaction. Earthbound Holistics participate in implementing needed (goods &) services, but Customer is solely responsible for the final outcomes, actions taken, and results produced.

4. COPYRIGHT.

All content produced by Earthbound Holistics including presentation slides, contents, graphics and design, or material developed by Earthbound Holistics for the customer as part of the Services, is copyrighted by Earthbound Holistics and remains the exclusive property of Earthbound Holistics. Upon termination of this Agreement, copyrights shall remain with Earthbound Holistics. The content contained within this service is protected by copyright, trademark and other intellectual property rights, as applicable, and is provided solely for your private, personal use.

5. TERM/TERMINATION.

Except for reasons of non-performance by either party, this Agreement shall remain in effect until formally terminated in writing by either party. Earthbound Holistics will bill to Customer on receipt of invoice/when customer agrees to these terms. Termination of this Agreement requires written or email notice delivered thirty (30) days prior to the desired date of termination. Failure to provide notice or a repeated failure to make payment by date due during any period gives Earthbound Holistics the option for immediate termination.

6. PAYMENT FOR SERVICES.

Should the customer wish to cancel a project at any point during the process they shall remain liable for the work that has taken place and shall be invoiced accordingly. Customer will pay fees to Earthbound Holistics as described in Earthbound Holistics invoice in effect at the time of this agreement. Payment will be made by BACS transfers. Invoices will include total fees and any additional fees for elective or other additional Services that have been purchased by the Customer.

7. WARRANTY.

Earthbound Holistics shall provide its services and meet its obligations under this Agreement in a timely and professional manner, using knowledge and skills consistent with generally acceptable standards in Earthbound Holistics industry, and will provide a standard of care based on commercially reasonable efforts. The services and all products provided as part of the services are provided “as is.” Earthbound Holistics does not warrant that the services provided hereunder will be uninterrupted or error-free. Under no circumstances, including negligence, shall the Company be liable for power outages, network issues or the inability to access the online sessions, if this should occur, Earthbound Holistics will reschedule.

8. DISCLAIMER:

Earthbound Holistics (goods &) services do not diagnose, cure, prevent or treat disease. The services offered are not intended for medical treatment, psychological, or psychiatric therapy. Our services are not facilitated by a medical professional. If you have a medical conditions or concern, please consult a licensed health care professional.
